1. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to use our Services. By accessing our site, you represent that you meet this requirement.
2. Use of Our Services
By placing an order, you represent that you are at least 21 years old. You agree to provide a biological sample (“Sample”) and acknowledge that Liv becomes the owner of the Sample and any data generated therefrom once received, subject to applicable consent and retention policies. We require completion of a standard questionnaire (and any supplemental questionnaires) before activating your kit. Orders are non-cancelable and fees are non-refundable, regardless of processing outcome, unless otherwise required by law. Kits ordered for others must be activated under their own accounts. Reports consist of biological age and related insights; underlying raw data, algorithms, and CpG sites will not be provided. We reserve the right to alter the format or content of reports at any time.
3. Health Information Disclaimer
We may change, modify, or update these Terms at our sole discretion. The most current version is always posted on our website. The Liv tests are not intended as health information or medical data, nor should they be used to screen, diagnose, treat, prevent, or assess risk of disease or medical condition. The Services are available only to individuals aged 21 years or older. The Services have not been cleared or approved by the U.S. Food and Drug Administration.
4. Sample Requirements
Each kit includes instructions and materials for collecting a Sample (e.g., saliva, swab, urine, or blood depending on product type). Kits are designed to yield sufficient DNA for up to two analyses. If the initial Sample fails, one replacement kit will be provided at no cost. If the replacement Sample is inadequate, the order is deemed terminated. Additional kits require a new purchase.
4. Privacy
Use of the Services is subject to the Liv Privacy Policy, incorporated by reference. By using the Service, you consent to our collection, processing, and de-identification of your Sample and personal data in accordance with that Policy.
5. Your Representations and Warranties
By ordering, you represent and warrant that:
5.1 You understand the Service is for informational purposes only and not medical advice.
5.2 You authorize Liv and its laboratories to process your Sample and generate results.
5.3 You are at least 21 years of age and legally authorized to order.
5.4 You acquire no rights in Liv intellectual property by providing a Sample.
5.5 You are not acting on behalf of an insurer, employer, or covered entity under HIPAA.
5.6 All information you provide is accurate and the Sample is your own.
5.7 Completion of required questionnaires is a condition of Service.
6. Intellectual Property
All materials on the Site—including text, graphics, logos, service marks, product packaging, and reports—are owned by LivBio or its licensors and protected by applicable intellectual property laws. You may access and download content only for personal, non-commercial use. Unauthorized reproduction, modification, distribution, or use is prohibited.
7. Prohibited Uses
You agree not to use the Site or Services for any unlawful purpose, to interfere with their operation, or to attempt unauthorized access. Prohibited conduct includes but is not limited to hacking, scraping, reverse engineering, or violating applicable laws.
8. Registration
Registration requires accurate account information and login credentials. Accounts are for individual use only; sharing of login credentials is prohibited. You are responsible for all activity under your account. LivBio may suspend or terminate access for violations or fraudulent use.
9. Third-Party Content
The Services may include third-party content or links to external websites. LivBio does not endorse, control, or assume responsibility for such content or sites.
10. Disclaimer of Warranties
The Service is provided “AS IS.” Liv disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation or accuracy of results.
11. Limitation of Liability
To the fullest extent permitted by law, LivBio and its affiliates are not liable for indirect, incidental, or consequential damages arising from your use of the Service. Total liability shall not exceed the amount you paid for the Service.
12. Indemnification
You agree to indemnify and hold harmless Liv, its officers, employees, and affiliates from claims, damages, or expenses (including attorneys’ fees) arising from your violation of these Terms or misuse of the Service.
13. Governing Law & Dispute Resolution
These Terms shall be governed by the laws of California, without regard to conflicts of law. Parties agree to negotiate in good faith for sixty (60) days before initiating arbitration. All disputes shall be resolved by final and binding arbitration under the American Arbitration Association rules for complex commercial transactions. Arbitration shall be conducted in Irvine or Costa Mesa, California by a panel of three arbitrators. Proceedings and outcomes shall be confidential, except as required by law. Either party may seek injunctive relief in court without waiving arbitration obligations. By using the Service, you waive claims under the laws of other jurisdictions.
14. Termination
Liv may suspend or terminate access at its discretion, including for violations of these Terms. Provisions related to intellectual property, liability, indemnification, and dispute resolution survive termination.
15. General
No waiver of any provision shall be deemed a further waiver of such or any other provision. These Terms constitute the entire agreement between you and Liv. If any provision is found invalid, the remainder shall remain in effect.
